These Terms of Use govern your use of thehorsenerd.com and any content, tip sheets, newsletters, and services offered by Horse Nerd, LLC, doing business as The Horse Nerd ("Horse Nerd," "we," "us"). By using the site or buying a product, you agree to these terms. If you do not agree, do not use the site.

1. What we provide

Horse Nerd publishes horse racing handicapping analysis, selections, educational content, and reference tools. All of it is opinion and information, intended for entertainment purposes only. Horse Nerd does not accept, place, or hold wagers, and is not a bookmaker, advance deposit wagering provider, or racetrack.

2. Eligibility

You must be at least 21 years old to buy a subscription or enter a contest, and you are responsible for following the wagering laws where you live. Nothing on this site is an offer or invitation to wager where wagering is illegal.

3. No guarantee of results

Horse racing outcomes are uncertain. Past results do not predict future results. You decide whether, what, and how much to wager, and you alone are responsible for any losses. See our Disclaimer & Responsible Gaming page.

4. Accounts

Some content requires an account or subscription. Keep your login private. One subscription covers one person; sharing logins or redistributing paid content may result in cancellation without refund.

5. Purchases and subscriptions

Prices, billing, renewals, cancellations, and refunds are governed by our Subscription & Refund Policy. Payments are processed by third-party payment processors; we do not store your full card number.

6. Intellectual property

All site content, including tip sheets, selections, articles, the glossary, payout tables, graphics, logos, and the Horse Nerd name, belongs to Horse Nerd or its licensors and is protected by copyright and trademark law. You may use it for your own personal handicapping. You may not copy, resell, republish, post, or distribute paid content, or scrape the site, without our written permission. Sharing a link to a free page is welcome.

7. Third-party links

The site links to outside sites, including racetrack workout videos and social media. We do not control those sites and are not responsible for their content or practices. Third-party content belongs to its owners.

8. Contests and promotions

Contests and giveaways are free to enter, require no purchase, and are governed by their own official rules, which control over these terms for that contest.

9. Acceptable use

Do not misuse the site: no hacking, automated scraping, interfering with the site, posting unlawful or abusive content, or impersonating others.

10. Disclaimer of warranties

The site and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, and non-infringement. Race data, odds, scratches, and results can change or contain errors; always confirm with the official track sources.

11. Limitation of liability

To the fullest extent allowed by law, Horse Nerd and its owners, members, and contractors are not liable for any indirect, incidental, special, or consequential damages, or for any wagering losses, arising from your use of the site or content. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

12. Indemnity

You agree to hold Horse Nerd harmless from claims arising from your misuse of the site or your violation of these terms.

13. Governing law

These terms are governed by the laws of the State of Arkansas. Any dispute will be brought in the state or federal courts located in Sebastian County, Arkansas, and you consent to that venue.

14. Changes

We may update these terms. The effective date above shows the latest version. Continued use after a change means you accept it.
